Judge Gives No Jail Time For Mother With 2nd DWI Because She Has A Son



Buffalo News – A woman who was stopped for driving while intoxicated on her way to an open house at her son’s school avoided incarceration Tuesday because of that child.

“I guess I’m concerned about your 8-year-old son. What happens to him?” asked State Supreme Court Justice Richard C. Kloch Sr. as he placed Jean M. Stahlman on five years’ probation for felony DWI.

Stahlman, 34, of Olympic Avenue, Buffalo, a former North Tonawanda resident, was arrested about 6 p.m. Sept. 17 at Walck Road and Zimmerman Street in North Tonawanda, where police measured her blood alcohol content at 0.25 percent.

She was driving without a license because of a prior DWI conviction, and Kloch said his usual policy is to send such drivers to prison. He ordered Stahlman to pay $1,605 in fines and fees, perform 200 hours of community service and wear an alcohol-detecting bracelet for up to a year.

Are you fucking kidding me? This bitch should be thrown behind bars and Kloch should lose his job ASAP. You are giving a mother a third chance to drive drunk with her son in the car. Good chance that happens again. CPS should have been called in right away and this kid should be in a foster home. Just incredible that this judge let this bitch off the hook. It’s her second fucking DWI. Got to love the comments in the comment section.

This is exactly why there are so many repeat drunk drivers. Maybe next time she will kill an innocent mother that won’t be so lucky to return home to her child. This sentence makes me sick.
